Fraudulent Application for Driver’s License or Vehicle Registration Documents

In order to protect the integrity of licenses issued in the state of New York, the DMV has taken measures to ensure that the documents that are issued are not counterfeit and have the best in security features.  The state has even recently signed a contract with a new license manufacturing companyto ensure that licenses in New York will be more difficult to counterfeit. In addition to creating a fake driver’s license or altering a license (commonly known as a “chalked ID”) there are other forms of driver’s license fraud.

What Is Driver’s License Fraud?

The New York Department of Motor Vehicles is cracking down on people that try and acquire a license through fraudulent means.  Last year Federal agents  arrested 22 people that were using fraudulent methods to allow immigrants from Korea to obtain valid driver’s licenses.

Driver’s license fraud is any misrepresentation or submission of counterfeit identity documents used to obtain a driver’s license.  Some examples of presenting false documents include presenting counterfeit immigration documents, counterfeit birth certificated or social security cards or using a legitimate birth certificate that belongs to another person.

The Criminal Fine & Jail Time

Article 12 of the Vehicle and Traffic Law section 392 makes it illegal (a crime) to provide a false statement on an application for a license/registration.  The fines start at $300 for a first offense and an $85 surcharge with a possible 30 day jail sentence.

Also New York Penal Law 175.30 states that a person may be charged with a Class A misdemeanor if they offer a false instrument for filing, knowing that a written instrument contains a false statement or false information, and offers it to a public office or public servant with the knowledge or belief that it will be filed with, registered or recorded in or otherwise become a part of the record of such public office or public servant.   A Class A misdemeanor can carry a one year jail sentence and substantial fines.

New York Penal Law Article 175.35 states that a person will be guilty of filing a false instrument in the first degree (E Felony) when the person knowingly offers a written instrument that contains a false statement or false information, and with intent to defraud the state or any political subdivision.

What Information Is Necessary To Acquire A Valid New York State Driver’s License?
