With the sixth installment of The Fast & Furious coming out in theaters before the summer hits you can be sure that many young drivers are going to get their cars souped up to push quicker acceleration and faster speeds over shorter distances. The movie should warn you “don’t try this at home,” or in this case on the streets or highways of New York State.
If you are thinking about carrying on a race you may want to reconsider since you will be charged with a crime if you are caught. New York Vehicle and Traffic Law (VTL) 1182 makes it illegal to stage races, exhibitions or contests of speed or to participate or aid in any speed contest of motor vehicles. The law covers everything from a staged race to revving up your engine at a red light for the purpose of racing.
What Are The Fines And Penalties For Being Charged With A Speed Contest?
Violation of New York VTL 1182 is a misdemeanor and may be punishable by a maximum of 30 days in jail and a fine of up to $525. A second conviction in 12 months is punishable by up to 60 days in jail and/or a maximum fine of $750. A bill is winding its way through the NYS legislature which states that if you are caught driving 30 miles over the speed limit while racing another vehicle then you can be charged with a Class E felony known as Aggravated Reckless Driving.
In addition, a first conviction can lead to a six-month revocation of driving privileges under VTL s510. A second conviction within three years of the first violation leads to a mandatory 1-year license revocation.
If you think about it, a speed contest is one traffic violation in which you can be charged with multiple other violations. A speed contest is separate from the charge of speeding itself and can also be charged separately from reckless driving. Speeding tickets and reckless driving are also both very heavy tickets which can have serious implications against your license.
Also, if someone is seriously injured during a speed contest or if alcohol is involved then the penalties and fines are even more significant. Not only are crimes not able to be sealed or expunged in New York, but you can also have your license revoked if you are found guilty of repeat speed contest offenses especially when there is injury or alcohol was involved.
